Jamaat candidate seeks leave to appeal challenging Sarwar Alamgir’s MP seat

Jamaat candidate Muhammad Nurul Amin has filed a leave-to-appeal petition against the High Court ruling that upheld the nomination of elected Chattogram-2 MP Sarwar Alamgir.

Nurul Amin’s lawyer, Azim Uddin Patowary, confirmed the information. He said the petition seeks a stay on the effect of the High Court judgment and an injunction preventing Sarwar Alamgir from attending parliamentary sessions until the case is resolved.

On July 9, a High Court bench comprising Justice Fahmida Qader and Justice Md Asif Hasan upheld Sarwar Alamgir’s nomination. He took oath as an MP that day.

After the returning officer declared Sarwar Alamgir’s candidacy valid in Chattogram-2, Jamaat candidate Muhammad Nurul Amin appealed to the Election Commission, alleging that Alamgir was a loan defaulter.

After a hearing, the Election Commission decided on January 18 to cancel Sarwar Alamgir’s candidacy. Alamgir then filed a writ petition in the High Court challenging the decision.

On January 27, the High Court stayed the Election Commission’s cancellation order. In its final judgment, it later upheld Sarwar Alamgir’s nomination.

Nurul Amin has now sought permission from the Supreme Court to appeal against that High Court ruling.
