Mirza Fakhrul Islam Alamgir has resigned as BNP secretary general after the party confirmed his nomination for president. If elected, he must take the prescribed oath before assuming office.
The oath is expected to be administered by acting speaker Barrister Kaysar Kamal.
Speaker of the Jatiya Sangsad Hafiz Uddin Ahmed is currently serving as acting president. Under article 74(3) of the constitution, when the speaker performs the duties of president, the functions of the speaker are carried out by the deputy speaker. With the speaker acting as president, those functions currently rest with Deputy Speaker Kaysar Kamal.
Under article 148 of the constitution, a person must take the prescribed oath before assuming any office listed in the third schedule, and the constitution specifies who administers the oath in each case.
On that constitutional reading, the duty of swearing in Mirza Fakhrul Islam Alamgir, should he be elected president, would fall to acting speaker Kaysar Kamal, because Speaker Hafiz Uddin Ahmed is serving as acting president and the functions of the speaker are for that reason being performed by the deputy speaker.
