The 2024 mass uprising did not follow Bangladesh’s constitution but broke it, Amar Bangladesh Party (AB Party) general secretary Barrister Asaduzzaman Fuad said on Sunday.
The government formed after August 5 drew its authority from the mandate of the uprising, he said, not from what he called the constitutional deception of Article 106.
He was speaking at a discussion at the National Press Club on October 25, organised by Bangladesh Jamaat-e-Islami to mark the first anniversary of the signing of the July National Charter.
Referring to the charter, Fuad said many BNP intellectuals had emerged after August 5, people “we did not know before”, and they mainly put forward two arguments. First, that the July Charter must be implemented letter by letter through the constitutional process. Second, that the wording of the referendum is too difficult for ordinary people to understand. “A fraud lies hidden in these two arguments. We have to make this political deception by the ruling party clear to the nation,” he said.
“War, mass uprisings, movements against autocracy and revolutions: none of them follows the articles and sub-clauses of a constitution,” he said. “The 2024 uprising also broke the constitution. The government formed after August 5 came entirely with the mandate of the uprising.”
Fuad alleged that since the uprising the whole debate had been steered, by design, towards the question of constitutional legitimacy, which in the end calls the legitimacy of the revolution itself into question. The government’s politics of double standards, knowingly or not, would make the February 12 election, the oath-taking and the formation of the government unlawful, which the BNP is unwilling to accept, he said.
“The BNP is calling lawful and permissible only as much of the uprising as suits it to keep its own throne,” he said. “This deception by the BNP will in the end call the legitimacy of its own rule into question.”
