The High Court has dismissed a writ petition that challenged the validity of Article 70 of the constitution, which provides for a parliamentary seat to become vacant if a member votes against their own party, and that sought to stay the schedule for the presidential election.
A High Court bench of Justice Khizir Ahmed Chowdhury and Justice A F M Saiful Karim issued the order Tuesday after hearing the writ petition.
Supreme Court lawyer Yunus Ali Akand filed the writ on August 13. He argued the case himself. Attorney General Md Ruhul Kuddus Kajal represented the state.
The Election Commission (EC) announced the schedule for the country’s 23rd presidential election on August 6. Under that schedule, the presidential election is set to be held this coming Thursday.
The writ had sought a rule asking why Article 70 of the constitution should not be declared inconsistent with the constitution, and why the Election Commission’s August 6 schedule for the presidential election should not be declared beyond its legal authority.
