Three families left homeless in Nilphamari after botched eviction

NILPHAMARI — Three families have been living in the open for three weeks in Nilphamari district after a court eviction order was wrongly carried out, destroying their homes and possessions, lawyers said.

The incident occurred on Oct. 11 in the Babrijhar area of Chapra Saramjani union in Nilphamari Sadar upazila.

A senior assistant judge’s court had ordered the eviction. On the decree-holder’s behalf, the court’s nazir, Mehedi Parvez, was directed to take possession in the presence of civil court commissioner Advocate Saidul Islam Shah, lawyers said.

The affected families say those carrying out the eviction destroyed trees and structures on adjoining land that was not part of the disputed property.

Defense lawyer Advocate Babul Hossain said the plaintiff, Lutfar Rahman, had filed Other Suit 16/15 in the senior assistant judge’s court in Nilphamari. The disputed land in that case was four decimals, and the suit sought removal of three tin-roofed houses belonging to the defendants. The court issued a decree ordering the removal of the tin-roofed houses on the four decimals.

The defendants then filed Other Appeal 95/24 in the district judge’s court, which is pending before the Additional District Judge’s Court-1, Hossain said.

The plaintiffs subsequently filed Other Ding 05/24 in the senior assistant judge’s court based on the decree from the earlier case. The defendants said they were not informed of the new case and received no notice from the court. When they learned of the possession warrant, they filed a petition for stay in the 95/24 appeal, and the court set Sept. 23, 2025, for a hearing.

But the plaintiffs, after learning of the stay petition, moved to take possession of the disputed land, Hossain said. On Sept. 11, 2025, although the court had ordered removal of four tin-roofed structures on the four decimals of disputed land, three structures within that area along with eight additional tin-roofed structures outside the disputed area were demolished and trees on adjoining land were cut down. The defendants estimate their losses at about 25 lakh taka.

The families said the land should have been measured and handed over to the plaintiffs at the time of the removal. They blamed those carrying out the eviction for not following the court’s order properly and said they have suffered severe financial losses. They are now living under polythene sheets in the open but remain hopeful of justice from the court, the families said.
