Major (retired) Mozaffar Hossain, an absconding convicted accused in the case over the assassination of late President Ziaur Rahman, will be tried under army law, Home Minister Salahuddin Ahmed has said. The home minister made the remarks to reporters on Monday afternoon after a durbar with senior officers at the Border Guard Bangladesh (BGB) headquarters in Pilkhana, in the capital.

Salahuddin Ahmed said there was no scope to try the same person for the same offence under two separate laws, so he had been handed over to the army for trial under army law rather than through the civilian process. The home minister said the trial of Major (retd) Mozaffar and his associates had taken place before a military court at the time, where there were certain findings. Mozaffar had been absconding, living for a long time under a different name in a neighbouring country.

“After he came to the country, once we learned of it, he was arrested on the basis of our intelligence agencies’ information and handed over to the army for trial under army law,” he said. “His trial will be completed through a general court martial. In light of the earlier verdict, under which others in the same case were tried and sentenced, the general court martial will consider what decision applies to him.” BGB Director General Major General Mohammad Ashrafuzzaman Siddiqui and senior officials of the home ministry and BGB were also present.
