A writ petition has been filed in the High Court challenging the legality of an education board notice suspending the formation of managing committees and governing bodies of the country’s private educational institutions until further notice. The petition seeks a rule on the notice’s legality and a stay on its effect.

A Supreme Court lawyer filed the petition with the relevant High Court section on Monday, 19 October. The education ministry secretary, the chairman of the Dhaka education board and other officials are named as respondents.

Lawyer Md Yunus Ali Akond confirmed the petition on Tuesday. He said the 2024 committee formation policy was still in force, and while it remained in force the education board could not order committee formation suspended. The writ was filed on that basis on Monday, he said.

On 15 October the Bangladesh Inter-Education Board Coordination Committee issued an urgent notice asking that the formation of governing bodies or managing committees of private educational institutions be suspended until further notice.

The notice from the committee’s president and the Dhaka education board said the 2026 regulations on forming governing bodies and managing committees of private lower-secondary, secondary and higher-secondary institutions had not yet been finalised. For that reason, it asked that committee formation at these institutions be suspended until further notice.

Copies of the notice were sent to the education ministry secretary, the director general of the Directorate of Secondary and Higher Education, the chairmen of all education boards, divisional commissioners, deputy commissioners, district education officers and the principals and head teachers of private lower-secondary, secondary and higher-secondary institutions and their equivalents.
