High Court to rule Tuesday on writ challenging presidential election schedule

The High Court will rule Tuesday on a writ petition challenging the validity of Article 70 of the constitution and seeking a stay of the presidential election schedule.

The High Court bench of Justice Khizir Ahmed Chowdhury and Justice A F M Saiful Karim set the date Monday, August 17.

Lawyer Md Yunus Ali Akand filed the writ petition last Thursday and argued the case himself.

Representing the state were Attorney General Md Ruhul Quddus Kajal, Deputy Attorney General Mamun Chowdhury, and Akhtar Hossain Md Abdul Wahab.

Article 70 of the constitution states: “If a member of parliament, having been elected as a candidate nominated by a political party, (a) resigns from that party, or (b) votes in parliament against that party, his seat in parliament shall become vacant, but he shall not thereby be disqualified from being elected a member of parliament in any subsequent election.” The lawyer said Article 70 prevents MPs from voting freely, thereby undermining their democratic rights.
